Terms & Conditions
Version 1, effective 20 September 2026. These terms apply to every purchase, pre-order, offer, auction bid and account made through Carmaxi.
1. Who These Terms Cover
These Terms & Conditions govern every vehicle sale, pre-order request, direct offer, and auction bid made with Car Maxi Limited (CAC RC 1895138), trading as Carmaxi, across our Abuja and Lagos showrooms and this website, and every account you hold with us. By purchasing a vehicle, submitting a pre-order request, making an offer, bidding in a Monday Auction, or creating an account, you agree to these terms and to our Privacy Policy.
2. AS-IS Sale Policy
Unless a written warranty is separately agreed and signed by both parties, every vehicle sold by Carmaxi, whether from inventory, a pre-order, or an auction lot, is sold AS-IS AND WHERE-IS, WITH ALL FAULTS. We do not warrant a vehicle's merchantability, fitness for a particular purpose, or condition beyond what is stated in the listing description and any inspection report we provide.
Buyers are encouraged to inspect a vehicle, or arrange an independent inspection, before completing a purchase or before bidding on an auction lot. Mileage, condition notes, and highlights shown on this site are provided in good faith but are not a guarantee, and normal wear consistent with a vehicle's age and mileage is expected and not grounds for a refund or price adjustment after sale.
3. Regular Sales (Inventory)
Checkout price is Vehicle Price + Buyer's Fee + VAT (currently 0%), shown in full before payment. These figures are set by Carmaxi and are not negotiable at the point of sale.
Ownership, insurance and risk pass to the buyer once full payment is received and a signed invoice or receipt is issued.
A listed vehicle may sell before your visit; availability is not guaranteed until a deposit or full payment is received.
4. Pre-Orders
A pre-order request is not a binding purchase. It becomes binding only once Carmaxi sends a written quote (landed cost, estimated timeline) and you confirm acceptance.
Quoted landed costs are estimates based on prices, shipping and duty rates known at the time of quoting, and may change before the vehicle is purchased on your behalf. We will notify you of any material change before proceeding.
Sourced vehicles are subject to the same AS-IS policy above once they arrive, based on the condition disclosed by the seller or auction house of origin; Carmaxi inspects documentation but does not physically inspect every sourced vehicle before purchase abroad.
Delivery timelines (including shipping, trucking and customs clearing) are estimates, not guarantees, and can be affected by factors outside our control (shipping schedules, customs processing, weather, and similar events).
Deposits paid toward a confirmed pre-order are non-refundable once Carmaxi has committed funds to purchase the vehicle on your behalf, except where the vehicle cannot be sourced at all.
Shipping charges for a pre-ordered vehicle are invoiced separately, as described in Section 5.
5. Shipping, Delivery & Exchange Rates
A pre-ordered vehicle is tracked through these stages: Vehicle Purchased, Driver in Route, Picked Up, Arrived at Port, Customs Cleared, Cargo in Ship, At Destination Port, and Delivered. Stage updates and estimated dates shown for a shipment are estimates and can change.
Shipping charges (trucking, ocean freight, and any storage or extra charges) are quoted in US dollars. When your cargo is loaded on the ship (the "Cargo in Ship" stage), we issue a shipping invoice in Naira by converting the total dollar amount at the exchange rate we set for that day. The rate is not stable, so we set it each time. The rate used is shown on your invoice and is fixed for that invoice: later movements in the exchange rate do not change it.
If a shipping invoice needs to be corrected before it is paid, we may issue a revised invoice. Once a shipping invoice is paid it is final unless we agree otherwise in writing.
A shipment is marked Delivered once the vehicle has been handed over to you or to a person you have authorised. The shipment is then closed. Please tell us promptly if you have a concern about your vehicle.
We may hold the release of a vehicle until every amount due for it, including shipping charges, has been paid.
Customs duties, port charges and other government charges arising in Nigeria are the buyer's responsibility unless they were included in the landed-cost quote you accepted.
6. Monday Auctions
Bidding requires a verified Dealer Auction Access License (see Dealer Auction Access). Carmaxi may decline or revoke access at its discretion, including for non-payment or repeated unredeemed wins.
Wallet security deposit: bidding access requires a one-time, refundable ₦200,000 deposit held in your Carmaxi wallet. Once your wallet holds this deposit, every bid offer you submit reaches our auction desk immediately, with no further payment per bid. The deposit is refunded if you do not win a lot, or applied toward the purchase if you do. A deposit may be forfeited if a winning bid is not honored.
Floor price: some lots are consigned with a seller's floor (reserve) price. If the winning bid is below that floor, the sale is not final until the seller approves or rejects it; a rejected bid does not result in a sale or invoice.
Bids are taken by phone or WhatsApp and posted to the site by our auction desk as the live current bid. Submitting an offer through the website is a request to bid, not a confirmed or winning bid until our team confirms it.
Buy Now: where a lot shows a Buy Now price, choosing it closes the lot to other bidders at that price and we issue your invoice straight away. It is a binding commitment to buy.
All auction lots are sold AS-IS AND WHERE-IS, WITH ALL FAULTS (see Section 2). Condition notes and highlights are informational only.
Auction checkout is Current Bid + Buyer's Fee + VAT (currently 0%), shown in full before payment.
Redemption window: a winning bidder has 5 days from the invoice date to redeem the lot (complete payment and collection or arrange delivery). A lot not redeemed within this window forfeits the ₦200,000 security deposit as a relisting fee, and the vehicle may be returned to auction or sold to another buyer.
Winning bids are binding. A bidder who fails to redeem a won lot and pay the relist fee may have their Dealer Auction Access License suspended or revoked.
7. Direct Offers
A direct offer on a vehicle is a request to buy at your price. It is not a sale until the offer is accepted, and an accepted offer is binding on both sides.
We or the seller may accept your offer, decline it, or answer with a counter-offer. A counter-offer stays open for 2 business days (Monday to Friday, on the Lagos calendar, not counting the day it is made). If you do not accept it in that time it expires.
If you make an offer on a vehicle listed by a seller, that seller can see your name and contact details so the sale can be completed.
8. Solutions Services
Trucking, Shipping & Delivery, and Car Hire quotes are estimates until confirmed in writing. Vehicles moved under our trucking or shipping service are insured for the journey as described on the relevant service page; hire vehicles are subject to a separate hire agreement provided at the time of booking.
9. Payments
Online payments are processed by Paystack, an independent payment provider. You enter your card or bank details on Paystack's page. We never see or store your full card details. Paystack's own terms and privacy notice apply to that payment.
A payment counts only once Paystack confirms it to us and the amount matches what is due. A payment that is declined, or that you leave without completing, is not a payment: you can try again. Your Payment History in your dashboard shows each attempt and how it turned out.
If we receive money that does not match what is due (for example, too little, or a second payment for something already paid), we hold it for review instead of applying it. We will contact you and then apply it, adjust it, or refund it. Refunds are made to the way you paid, and the time they take depends on the payment provider and your bank.
A bank transfer counts as payment only after we have seen it in our account and recorded it against your invoice with the bank's reference. Pay only to the account details shown on your invoice or given to you by us in writing. We are not responsible for money sent to any other account.
Amounts are in Naira (₦). Where a charge is quoted in US dollars, Section 5 applies.
If you have a problem with a payment, please contact us before raising a dispute with your bank, so we can help quickly.
10. Membership, Fees & Account Security
Buyer Membership: a one-time ₦50,000 fee, valid for one year from the day it is paid. After that, bidding access needs the membership to be renewed (the fee only; your refundable deposit stays in your wallet). The Buyer Membership fee is not refundable.
Dealer/Seller Membership: a one-time ₦50,000 membership fee unlocks listing access. An inspection fee of ₦20,000 applies to a vehicle inspection.
Fees you have paid are not refundable unless we say so in writing or the law requires it.
Buyer Member and Dealer/Seller Member registration requires accurate KYC information and acceptance of these terms. We monitor accounts for fraudulent activity and may suspend, ban, or disable a Buyer or Dealer/Seller account, without refund of membership fees, where fraud is reasonably suspected.
Members who arrange or complete a vehicle transaction outside the platform (bypassing Carmaxi's checkout, invoicing or escrow process) may have their membership revoked, subject to these terms and applicable Nigerian law.
Keep your password to yourself. You are responsible for what is done through your account until you tell us that someone else has gained access, and you should tell us straight away if you think that has happened. We may suspend an account at once to protect it.
11. Limitation of Liability
To the fullest extent permitted by Nigerian law, Car Maxi Limited is not liable for indirect, incidental or consequential loss arising from a purchase, pre-order, auction bid, or Solutions service, beyond the amount actually paid for the vehicle or service in question.
12. Arbitration & Listing Accuracy Policy
If a vehicle materially differs from its published Condition Report, photos, mileage, or VIN in a way not disclosed at sale, a buyer may raise a listing-accuracy dispute within 7 days of redemption, in writing, through the Services & Support section of their dashboard or at either showroom, with photos and supporting evidence.
Car Maxi Limited investigates every dispute against the inspecting mechanic's Condition Report and any available vehicle history. Remedies, at our discretion, may include a price adjustment, repair reimbursement up to a reasonable amount, or a full refund and vehicle return where the inaccuracy is confirmed material and undisclosed.
A Dealer/Seller Member found to have knowingly misrepresented a vehicle's condition, mileage, title status, or VIN faces membership suspension or termination, forfeiture of the listing in question, and referral to the appropriate authorities where the conduct amounts to fraud under Nigerian law. This policy does not limit either party's right to pursue civil or criminal remedies independently of Carmaxi.
13. Electronic Communications
You agree that we may send you invoices, receipts, shipment updates, notices and other messages using the email address and phone number on your account, and through your dashboard. Keep those details up to date. Our records of your orders, payments and messages are good evidence of what took place, unless there is an obvious mistake.
14. Privacy & Cookies
How we handle your personal information, including identity documents, is described in our Privacy Policy, which forms part of these terms. The cookies we use are described in the Cookies section of that policy.
15. Changes to These Terms
We may update these terms. The current version and the date it took effect are shown at the top of this page. When a change is important, we will ask you to accept the new version the next time you sign in, and you will need to do so to keep using your account. A change does not alter a purchase, bid or order that was already confirmed, unless the law requires it.

These terms are governed by the laws of the Federal Republic of Nigeria.
